I've been thinking about this every day since the Supreme Court issued a ruling that watered-down the Fourth Amendment's "right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures..."
I pay to Heather Cox Richardson, Rebecca Solnit, Timothy Snyder, and Sarah Kendzior.
May end up also sending $$$ to Glenn here.
But now am simply sending note -- hope others here will appreciate it -- that in addition to Dred Scott, Plessy v. Ferguson, and Korematsu, we have two other disgraces from the high court: Citizens United of 2010 and the granting of immunity from our laws to King Donald in 2023.
I'm glad to see the evidence of Donald's years-long crimes emerging as regards his role in Jeffrey and Ghislaine's international trafficking business. But I'm also sickened to acknowledge U.S. schools by dehumanizing and also by letting IQ-testing-only rule has normalized so much only quasi-hidden criminality.
Much appreciate Glenn in recent years -- hope his community here nears his levels of most-apt articulation.
The cracks in US society are now wide open. It’s just like Niemoller’s oft-repeated sermon about Nazi Germany that begins “First they came for the Communists, But I was not a Communist, so I did not speak out….” Well, in the US, Joseph McCarthy DID come for the “Communists” in the early 1950s and very few people spoke out until careers and lives were ruined. It eventually trickled up to the public Army Senate hearing which, thanks to Attorney Joseph Welch, turned public opinion. When Welch addressed McCarthy saying "Until this moment, Senator, I think I never really gauged your cruelty or your recklessness…Have you no sense of decency, sir, at long last?", it was as if a spell had been broken.
Would that the same thing could have happened after the Bondi Senate debacle this week but I fear we still have a ways to go….
I've seen a number of contemporary variations of Niemoller's poem fitted to the current 🍊💩 regime, but the best I've seen so far was simply "first they came for the journalists… We don't know what happened after that." 😱😰🙀
I think some in the legal profession--or perhaps more in the lower courts--are redeeming themselves from "first we kill all the lawyers". They are presenting a bit of a bulwark thank goodness.
And the Extreme Court also gave us Bush v. Gore and Citizens United and Shelby v. Holder and the Moslem Ban. Not entirely coincidentally some of the same malfeasants.
Perhaps it's just that I have never been part of the loop, any loop. But given that there seems to be a fair consensus among normal people that Supreme Court changes and reforms need to be made, it would be good for the Democrats to officially form a working group of legislators, judges, members of the bar, law school faculty, and interest groups to start developing a formal consensus of at least some reforms that can be the nexus for actual legislation that could be put forth, at least in draft form, even BEFORE THE ELECTION IN NOVEMBER. Something tangible that can be fought for.
Democrats have never really highlighted that the Republiscum have been promising a health plan to be released in about two weeks ... repeatedly ... since Bill Clinton was president ... over 30 years, a complete generation, ago. Horribly left on the table following the Harris v. Chump debate and even since was that Degenerate Don publicly admitted that he (and the Republiscum) didn't have a health plan, never had a health plan, and after 30+ years don't even have an outline fora plan for a plan for a health plan.
Of course they don't have a health plan because they think the government should only exist to help billionaires become trillionaires and allow corporations to pollute our air and water as they make money in any way that they can.
We will do what must be done to repair and improve our entire Constitutional freedoms from, ever again, having an unstable, convicted felons qualify for a government job let alone the highest position in our democracy. Our work will be decades long and arduous, but if we want to keep this republic, we will persevere. I may not live long enough to see it, but our children, grandchildren and beyond will live in freedom. That fills my heart with joy and determination to do whatever I can to be part of the solution to our current debacle.
I always felt the Constitution, drawn up by fair n honest men for the good of all, covered all basis. I suppose at the time of the drawing of the Constitution, it could not be believed that there could be such wicked, greedy and dangerous criminals, running the government of USA
Reminder: It wasn't very far back in our nation's history the Irish Catholics were among the most readily profiled and despised of immigrants. In living memory there was a great rumbling in America about voting a Kennedy into the highest office in our land, for instance. The ladder Kavanaugh climbed was built in large measure by people born in foreign lands.
Humility is a much higher order character attribute than hubris.

Don't you guys know Kavanaugh is in the Epstein files? Don't you remember how the FBI wouldn't investigate the numerous charges against him. Give me a break! Why do you think Trump nominated him? Kindred spirits! Look him up. He is in there hook, line, and sinker! Will be impeached when the head start rolling in this country like overseas!
I read a lot about the Epstein files and have not come across his name yet by any Substack writers. You sound incredulous that we don’t know. That’s an insult, I follow closely . But I guess not close enough. Thanks for sharing this vital piece of evidence not understood by MANY of us.
It's all being done with "malice of forethought," combined with this evil disruption of "Voter ID." And "Real ID and the confusing voting disparities between the states. It has all the hallmarks of an intention to corrupt the upcoming elections.
On this Sunday morning, I just want to express how much I appreciate you and your analysis of court cases and most of all your dedication to justice. THank you.
Glenn, could you summarize the "Kavanaugh Stops" article? I'm trying to keep my subscriptions under control and Slade wants money to read the article... Thank you for all you do!!
“Brett Kavanaugh Is Trying to Walk Back ‘Kavanaugh Stops.’ Too Late.”
By Dahlia Lithwick and Mark Joseph Stern
The article argues that Justice Brett Kavanaugh is attempting to moderate or reframe his prior approach to emergency Supreme Court interventions—informally referred to as “Kavanaugh stops”—but that the institutional and legal consequences of his earlier positions have already taken hold.
The authors focus on the Supreme Court’s increasing use of the “shadow docket,” meaning emergency orders and unsigned decisions issued without full briefing or oral argument. During the Trump administration, Kavanaugh frequently voted to grant emergency relief to block lower-court rulings, particularly in cases involving immigration, abortion, environmental regulation, and other federal policies. Critics argued that this practice expanded executive power and weakened traditional procedural safeguards.
According to the article, Kavanaugh has more recently expressed concerns about the Court’s emergency-docket practices and has suggested limits on when such extraordinary relief should be granted. However, Lithwick and Stern contend that these new signals of restraint come after years in which the Court—often with Kavanaugh’s support—normalized aggressive emergency intervention. In their view, the Court’s credibility and procedural norms have already been altered.
The authors frame Kavanaugh’s shift as an effort to restore balance or protect the Court’s institutional legitimacy, but they argue that the precedent for expansive use of emergency orders is now entrenched and cannot easily be reversed.
In short, the article maintains that Kavanaugh is attempting to recalibrate the Court’s approach to emergency rulings, but that the structural and reputational effects of prior decisions make that recalibration insufficient or too late.
Constitutional insults should never be forgiven. We have remedies; we just need the will.
I believe in the 4th amendment and will fight for it.
As will I.
Thank you for not charging to comment..many of us low income educated seniors don’t have the funds to pay..you are appreciated!

Same here, disabled vet on social security
Arrest. Impeach. Incarcerate.
Rebuild.
Repeat.
Recalibrate
Reload
Reengage
well summarized! Fits perfectly on a bumper sticker. But I believe the correct order on that should be:
Impeach. Arrest. Incarcerate. Rebuild. 🤞🏻💙🇺🇸‼️
cuz i'm pretty sure they can't be arrested until after they've been impeached, but I could be wrong... anyone? anyone? Bueler? 🤣🤣

No, we don’t know that!!! Thank you for clearly stating that fact. Can you give some references please?
