I still do not understand how the SC blew past the the fact that this was a clandestine event.

I did not hear that at all. I heard they did not “in the majority” allow this decision in its totality blow past how the deportations were handled. They ruled that procedure must be followed, i.e. the rights afforded everyone in this country no matter what their standing, color or creed must be abided by. That is major! That means we our rights are under the Constitution are recognized and cemented by this Supreme Court ruling.

But he didn’t make him bring back the innocent people and he let him continue to fire the 65,000 probationary employees. These are not wins for freedom or the constitution! These people’s rights were violated and no one is making this right!

The court can only rule on what is brought before them. I will need to listen again but did not hear that the Supreme Court was asked to rule on either of those matters. The ball is now in the hands of the DOJ, and they have displayed some measure of incompetence.

The courts and Judges to date are abiding by their oath which was somet3hing affirmed by the American Bar Association at the very beginning of Trump’s administration when he pardoned the insurrectionists. I our judges, and state attorney generals and courts as the goalies in a game of hockey deflecting the enemy from scoring.

We the people are the players on the field. We showed the amazing potential of and weight of our collective and unified power last Saturday when five million people came out. Hope everyone was at an event. But that five million though grand and seen across the world at 1.5% of the population does not hit the sweet spot of what we need for all future protests with is 3.5% of us.

We cannot afford to fail to rise to the occasion. Plan A: Everyone who showed on Saturday commit to attend every national and local protest going forward and we invite the 2% needed last Saturday to join us; then as an insurance plan everyone plan to bring two people and ask that each of those bring two and each of those bring two, etc. We need 3.5% of the population nothing less.

“Going forward”. “Going forward”. What about going back and going now? what’s the next step now to fix this. Maybe some of them really Are scumbags, but Habeus Corpus. Produce the body of evidence and let the trials begin. How about it? Even a scumbag gets his day in court.

What this bogus court fails to recognize in their list of “shouldas” is that these people shoulda never been swept up and criminally deprived of their rights IN THE FIRST PLACE. If this craven regime were hellbent on confiscating them and having it stick, do it lawfully. But don’t chastise these victims for “choosing the wrong venue,” or what the hell. They should not be in this mess PERIOD. The relentless arrogance of these …. justices (you know who they are) is continually nauseating.

Only the best from Glenn Kirschner who puts in the work for us and informs brilliantly. And thank you for reading the densely written decision many times over so you could deliver a top-flight analysis versus what our despicable media at large is known for, which is grabbing a headline, and not serving anyone of their readers.

Thank you Raissa. I'll keep doing my best, daily, to translate these opinions from legalese to English. We need to keep fighting, keep protesting, keep speaking up, and keep explaining that a healthy rule of law is vitally important to a healthy democracy.

This clarifies and gives hope. I was pretty depressed yesterday and today about this. It’s still a travesty that these individuals, and most pointedly Abrego Garcia, must languish forgotten down there. There has to be some legal remedy to bring them home. There has to be.

So, what if mainstream media misinforms those who look no further than mainstream media — the MAGAs read it listening for what they want to hear and the way I see if they are clueless that only works for us, not against us. It will be for us like Washington’s crossing of the Delaware arriving in enemy territory on Christmas morning to a very surprised and hung over easily defeated enemy. Let them think they are winning, and can rest which was Washington’s strategy, while we work like hell to defeat them.

The best way to take control of the end story is to show up at the protests at this point. Pressure break pipes. There is a power a unified body of people brings forth. Be there. We need 3.5% of the overall population at all the protest going forward to reach the level of pressure that topples autocrats.

Saturday was grand! People in many parts of the country stood for two hours in rain and wind. And the people of our allied nations held protests timed for the same day in support of us the people of America!

But we did not hit that sweet spot of 3.5% of the population in attendance. Let’s focus on what we the people bring to this game. Plan your protests. Invite people. Volunteer at the local level. The courts are doing their job. We have a job to do as well.

Look to Ukraine and what they have done unified and by the sheer force of the people on the ground. Their sheer willpower and drive that makes losing their democracy worse to them than death has brought Putin to his knees.

Russia’s economy is a failed one, Putin is funding the military with his country’s gold reserves which as a reference point is like stealing from Fort Knox, and he is a sick dying old man under threats of death from his own people; and the author of the deaths of close to a million young people conscripted into his vanity war with Ukraine.

Ukraine should be our example. Makes taking a few hours for a protest look like a walk in the park. Sign up. Show up. Bring two people with you! We need 3.5% of the population at every protest going forward. Nothing less will do.

I agree on all counts. The media is really struggling to cover things with any depth. Saturday was very empowering and I look forward to the 19th. And yet somehow, it doesn’t feel like enough. Speaking out and writing letters and donating to Democracy Forward and other organizations helps. It’s hard to watch this train wreck occur.

I’m not a lawyer or legal expert. But it seems to me this decision was no more than a rap across the knuckles to the Trump administration. It was easy for those five right wing justices to fall back on the clear and unambiguous wording in law that the deportees were entitled to due process prior to deportation. They couldn’t say anything else. I think they went along with the other four justices to ‘soften the blow’ of their cowardly opinion. Bottom line, the Trump administration can’t do this again but they got away with it this time. And it wouldn’t surprise me if they also get a pass on repatriating Mr. Garcia.

The Judges should be aware that they could be put in the same prison if they agree with the dear leader.

He has a record of turning on people who help him. Then it will be too late for them to do the right thing.

Finally got on. Great episode, Glenn! Hands off of us federal employees, hands off our judges, and hands off the constitution.

While you didn’t cover it here for obvious reasons, I think it bears repeating that Trump, et al., are in fact running a legitimate criminal enterprise from the Oval Office. The #TrumpRICOEnterprise is alive and well and has arguably joined forces with the #MuskRICOEnterprise. As a Musk/Tesla federal whistleblower and current federal LE professional, I can assure the American people that what we’ve seen by Musk & his faux agency DOGE at the behest of the felon-in-chief Trump, is in fact wholly relevant to the Musk criminal playbook. Anyway, thank you for all you do. I’m grateful for your service and the work you do!
